
Normally I would find something like that hilarious...but a 10 year old girl? Wow. That's a lawsuit. And with that said, I'll be the first one to say: there is one person who went and ruined it for the whole lot of us. Chances are, soon, we aren't going to be able to make returns...
Then there was the boy who opened his PlayStation 3 box on Christmas to find a telephone book inside. The parents called the news first to publicize the story because they were afraid the store wouldn't believe them when they took it back....I think I'd be a little more than pissed to find out I bought a $500 phonebook....
My first 2 thoughts...wouldn't any good parent pre-load the MP3 player before Christmas morning? Therefore the parents would have already found that stuff, and deleted it. Oh wait, second thought, the parents would leave it so they could sue instead. It's a shame the poor kid had to see the porn videos and hear the inappropriate music, but is it really worth suing over? Give me a break!

Hey Saik! You're right, the store should have checked it out before putting it back on the shelf. Whoever bought it probably left all that on there on purpose. It's amazing the things I've found on store shelves that shouldn't have been put back. American's are way too happy to sue these days though. There should be a law to stop ridiculous lawsuits.
Unfortunately, that would mean they would have to take people away from IMPORTANT jobs (such as greeting and passing out samples) in order to do something that is actually necessary... Let me tell you, if I am not greeted at Wal-mart each and every time I walk in, there will be Hell to pay...

People are just money hungry. That lawsuit will only have to do with that child by the wording on the paper.
My parents just leave the stuff in the box and let me be the first one to use it. I probably wouldn't think to open the mp3 player either unless I knew it was used, because what company puts bad things on an mp3 player? If I knew it was used, I'd definitely check it out. I agree with the fact that it isn't worth suing over, though. Unless my kid was seriously scarred by it, I would have just complained to the store.

I just think it's a better gift if you load stuff on it already so it can be used immediately. That includes charging anything, and having batteries ready on Christmas morning. Maybe I just think too far ahead.
