Bush the Geneva Convention and The War Crimes Act
    RE: Detainee treatment, torture, and trial issues

   Imagine allowing to cut off all judicial review of the U.S. in
regards to compliance with the Geneva Conventions.

     The inclusion of the immunity clause that retroactively legalized all the
unlawful acts that were approved and performed from 2001 to the present day

     Be aware that every law that alters the legal rules of evidence, so that one can receive less,
 or different, sentence than the law required at the time of the commission of the offense ;

   That such a law violates Art. I, Secs. 9 (Cl. 3) & 10 of the Constitution of the United States
 which provide that neither Congress nor any state shall pass an ex post facto law;

   NOTE: That provision have been held applicable only to criminal statutes.

   FACT: The War Crimes Act is part of the US criminal code.

      Ask yourself why they would be find it so necessary to try
         to protect themselves from accusations of war crimes.

 No authority should ever be given to have the way justify the means.

 Out takes from the.....

         Third Geneva Convention

 Article 3 describes minimal protections......
The passing of sentences must also be pronounced by a regularly constituted court,
affording all the judicial guarantees which are recognized as indispensable by civilized peoples.

 Article 3's protections exist even if one is not classified as a prisoner of war.

 Article 4 defines prisoners of war

 Article 5 specifies that prisoners of war (as defined in article 4) are protected
from the time of their capture until their final repatriation.

   It also specifies that when there is any doubt as to whether a combatant belongs to the categories in article 4,
 they should be treated as such until their status has been determined by a competent tribunal.

 Article 17  "No physical or mental torture, nor any other form of coercion, may be inflicted
on prisoners of war to secure from them information of any kind whatever.
   Prisoners of war who refuse to answer may not be threatened, insulted or
exposed to unpleasant or disadvantageous treatment of any kind."

       The Fourth Geneva Convention

   Relates to the protection of civilians during times of war "in the hands"
of an enemy and under any occupation by a foreign power.

      Article 3 states.....
  Must as a minimum adhere to minimal protections described.....

detention, or any other cause shall in all circumstances be treated humanely, with the following prohibitions:

(a) violence to life and person, in particular murder of all kinds, mutilation, cruel treatment and torture;

(c) outrages upon personal dignity, in particular humiliating and degrading treatment;

   Article 33. No protected person may be punished for an offense he or she has not personally committed.

Collective penalties and likewise all measures of intimidation or of terrorism are prohibited.

         Make you wonder why.....
 A clause that acts to protect the CIA who were "just following orders," but also retroactively
try's to immunize the Bush administration officials for ordering violations of the Geneva Conventions.

Maybe I'm the only one, but I think retroactively legalizing war crimes is a pretty big deal.

To preserve, protect and defend the
 Constitution of the United States

  The Bush administration had not fulfilled the United States obligations under the Geneva Conventions

  Excerpt: Article. VI. - The U.S. Constitution.... and all Treaties made, or which shall be made, under the
 Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be
 bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

   Time has long passed to call for impeachment and
 if necessary  the conviction for high crimes and misdemeanors

If laws were broken then we must convict all of the offenders.

   America and Washington are following in similar paths to Nazi Germany
The people of this country need to wake up and get curious with what is happening.

Re: The immunity clause, The War Crimes Act, an ex post facto Law passed
Whats up ???? I've only been gone a few days and some how it seems to me
 that theres a political and social uprising here at Mindsay.

Since I have no clue on how or what started it all, all I can really say is you sure do have a way to
 get people talking here, and hopefully at the very least open up some minds to at the very least ask
 questions and maybe open up some  minds a little to the many alternate reality's.

As the saying  goes "I may not agree with you but I will defend you right to it even if your dumb ass
 is wrong"  please note that that is a general comment to everyone here on Mindsay.

. There is only a few things that I have found in my life to be absolutely true, they would be, that no
 one has all the answers and there is usually more than one correct answer to most problems.

I must say you do have a way with people Aaron. keep up the good work.

Re: The U.S., working to bring people together
I don't think I will.  Basically you could take the combined reaction to everything I've written, about our government killing it's own people to build support for war, economic takeovers of foreign nations, CIA instigated coups and assassinations,  torture and rape of innocent civilians as a matter of policy and so on, and essentially the reaction I get for using "bad" language is so much exponentially greater it's ridiculous.

Basically I got pissed because shortly after writing a couple of blogs about why I don't believe in religion, Sandyquill responded with a blog stating that such thoughts were the opinions propagated and spread by the Devil as propaganda.  Which while insulting and quite stupid is apparently  not considered judging someone.  So I went off on her for her beliefs, which apparently is judging someone.  Being uncouth or vulgar when talking about politics is wrong, but giving blatantly false information is about countries we want to invade for oil is fine.

Additionally, I'm deluded and paranoid because I don't believe the fire on a top floor of a steel framed structure can simultaneously melt the entire steel frame and cause the building to collapse into it's own basement, but misled and wrong to not to believe the earth was created by an invisible man 6000 years ago.

I'm a jackass for attacking people on their own blogs where they have complete control over whether or not my comments are even shown, and where they are defended by the friends in their network, but the response wherein people block me and immediately write blogs attacking me I can neither read nor respond to in order to defend myself is perfectly acceptable.

After all this time I've found the only way to get a reaction is to either insult people, use bad language, or dismiss their erroneous beliefs.  People simply don't care about torture, murder, genocide, war, or conspiracies.  They care about American idol and political correctness in grammar.  They care about simple subjects that are easy to understand and either can't be bothered to take the time or aren't capable of grasping anything more.

In any case, because of my blogging I haven't had time to read for months, and essentially the only people who listen are the ones who already know anyway.  It's a waste of my time, but I do enjoy writing, so I'm not going to delete my blog.  However, I don't enjoy people, or at least I don't enjoy the simian semi people I typically have to deal with, so I took everyone off my friends list and made my blog private so I can still write for myself without having to introduce drama.  Writing helps me to organize my thoughts, so there's really no need for an audience and in addition since I only have my lunch, it will give me time to read again and there's quite a few books I need to check out.

So, you are the only one I've explained this too, and that's about as much effort as I plan on putting into it.  Many of the people on my friends list I have a great deal of respect for, yourself included, but as a community the same lowest common denominator tendencies apply here that apply to the rest of the world.  There's no real hope for change, and no real chance of education.  If I really wanted to get people to believe, it would be far more effective to make things up and simultaneously profess a devotion to god then to do any kind of research and pass along information.  They are not capable of educating themselves, or of even making relatively informed decisions.

The world is the way it is because that's what we deserve.  Most people are dumb enough to be easily led and manipulated, and if there are people who have the initiative to take advantage of that, more power to them.  It's a world of monkeys, so there's bound to be a few zookeepers.
